Introduction

AntWalk (together with its subsidiaries, and its affiliates, hereinafter referred to as “AntWalk”, "us," "we," "our" or “Company”) is committed to security and management of personal data and / or information, to function effectively and successfully for the benefit of our stakeholders, customers and for the community. In doing so, it is essential that your privacy is protected through the lawful and appropriate means for handling the personal data. Therefore, we have implemented this Policy (defined below). This Policy is an electronic record in the form of an electronic contract created between You and AntWalk in accordance with the Information Technology Act, 2000 and the Rules (defined below) framed thereunder. There is no need for a physical, digital, or electronic signature on this Policy.

Definitions

“Account” shall mean the account created on the Platform by or on behalf of the User for use of the Services.

Information shall mean both Personal and Sensitive Personal Data or Information.

Personal Information refers to any information that identifies or can be used to identify, contact or locate the person to whom such information pertains including but not limited to name, address, phone number and email address disclosed by you in relation to the Services available on AntWalk Platform.

Platform means the AntWalk’s website and shall include any and all associated firmware, applications, software, websites, APIs, products, and services that are connected to the Platform.

Platform Services means all services and content provided by the Company on any of the Platforms (including through an SD card, any reports, information, market place offerings, blogs, videos and any educational and academic material and content), whether free or paid.

Policy shall mean this privacy policy for AntWalk Private Limited.

Rules shall mean the rules framed under Information Technology Act, 2000 including Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, etc.

Sensitive Personal Data or Information shall mean information relating to the following: passwords; financial information such as bank account or credit card or debit card or other payment instrument details; physical, physiological and mental health condition; sexual orientation; medical records and history; biometric information; any detail relating to the above clauses as provided to body corporate for providing service; and any of the information received under above clauses by body corporate for processing, stored or processed under lawful contract or otherwise.

Services shall mean the Platform and the Platform Services owned, developed, distributed, or offered by the Company to the User.

Third Party means any person or entity other than you or the Company.

Third Party Account shall mean any account on any Third Party platforms including but not limited to Facebook, Twitter, LinkedIn, Google+.

Terms shall mean terms and conditions of usage of our Platform.

User (“you”, “your”, and “yourself”) shall mean any user of the AntWalk Platform and/ or Services.

Purpose

This Policy explains how we use your Information, which you provide to us when using our Services, including but not limited to AntWalk Platform.

Unless we link to a different policy or state otherwise, this Policy applies when you visit or use our website, Platform, mobile, applications, APIs or related Services.

By using the Services, you agree to the terms of this Policy. You shouldn’t use the Services if you don’t agree with this Policy or any other agreement that governs your use of the Services.

Collection of Information

When you buy, download, register, access, or use any of the Company's Services, the Company receives the Information. When you sign up with the Company or you access the Platform, you typically give us (a) your name, email address and phone number; (b) transaction-related information when you respond to any offers from us; (c) information that is typically given when you contact us for help/assistance; and (d) other information you enters or uploads into our system when using the Platform. The aforementioned details are required in order for the Company to run the Platform and offer the Services to Users.

To provide you a safe, efficient, smooth and customized experience, for you to take advantage of certain features available on AntWalk Platform including but not limited to public forums, accessing or uploading reviews or taking part in surveys, you may be asked to complete an online registration form which will provide us with Personal Information. In the event you register with us, you will also be asked to choose a ‘user identity’ (or username) and form a password to identify yourself and access Services during future uses of AntWalk Platform.

We may gather usage data regarding how you a use our Services, such as the number of tests and exercises you have attempted on the Platform, the number of videos you and/or a have watched, the live classes, conversations, and interactive questions in which you participate, and the time it takes to finish an exercise on the Platform. As a result, we can more effectively create educational experiences that are suitable for you.

We may use a variety of technologies that automatically record specific technical information from your browser when you visit or accesses our Platform, read our emails, use our Services, or otherwise interacts with us in order to provide a personalised learning and high- quality experience for our Users. Various tracking technologies such as cookies, web beacons, flash objects, log files, and other tools are typically used to gather this information. These tracking technologies gather data on your usage of the Services.

To measure traffic and usage trends for the Platform and to learn more about the demographics of our Users, we may gather analytics data or make use of third-party analytics tools. We might potentially collaborate with other partners to leverage technologies that help us deliver the Services and improve user experience. The terms of use and privacy policies of any third-party services used by the Company, as well as any relevant legislation, shall apply to those services.

Information You Choose to Give the Company

You may choose to provide to the Company (through the Platform), additional Personal Information in order to obtain a better user experience when using Platform. This additional Personal Information will be processed based on your consent.

Additional Profile Information: You may choose to provide additional information as part of your profile (such as company name, gender, age, etc.).

Other Information: You may otherwise choose to provide us information when you fill in a form, conducts a search, updates or adds information to your Account, respond to surveys, posts to community forums, participates in promotions, or uses other features of the Platform.

Please note that if you disclose Personal Information when responding to surveys, posting on community forums, participating in promotions, or using any other feature/ functionalities of the Platform, you do so at your own risk and that such Personal Information may become publicly available.

Cookies are small pieces of information saved by your browser. Cookies are used to record various aspects of your visit and assist us to provide you with uninterrupted service. Cookies are transferred by us to your device’s hard drive through your browser when you access AntWalk Platform or may be set in when you visit Third Party websites. This anonymous information is maintained distinctly and is not linked to the Information that you submit to us

  • to analyse the use and performance of our website and services;
  • to enable our security features;
  • to show you advertising; and
  • to improve and develop the features of AntWalk Platform.
  • In addition to Cookies, we use web beacons, ad tags, pixels to advertise as part of AntWalk Platform. The abovementioned data may be used by us and may be shared with our sponsors, investors, advertisers, developers, strategic business partners or other associates to enhance and grow the user experience in relation to AntWalk Platform.

    Purposes of Collection, Storing and Using Your Information

    The Company uses, stores, and processes Information, about you for the following purposes:

  • To fulfil or meet the purposes for which such Information is obtained;
  • To provide and administer the Services, including to facilitate participation in educational content, issue completion certificates, display customized content, and facilitate communication with other users;
  • To use the Information to provide, develop, enhance and improve the Services, conduct relevant research, create internal guidelines for content creation, and record and register geographic influences of the Services.
  • The Information collected is used for internal operational purposes such as spam and abuse prevention, enforcing content license restrictions, determining preferred language and providing and improving the Services.
  • To offer Users personalized content based on their request, search history, and key words used in navigating the Platform, as well as usage history of the Platform.
  • To provide Information collected on the Platform to Company’s affiliates, other third parties, including those who are working with the Company (i) to operate (including analyzing data), improve and enhance the features and experiences on the Services, and (ii) for relevant research and analytics on the Services or in connection with the services provided by such third parties, which may be by way of providing access to the Information on the Company’s servers and/or transferring the Information to the servers of such third parties.
  • Further, notwithstanding anything to the contrary contained herein, you may at any time choose to provide a written notice to the Company to revoke the consent given by you to share Information with third parties who are working with the Company. Upon receipt of such notice, we may not be able to continue to provide you with the Services (or any part thereof). Please note that the Company shall not be responsible or liable in any manner whatsoever for any actions of any third parties that receive the Information.
  • We may contact you via tele-call, email, SMS, multimedia message service (MMS) or other forms of communication for, inter alia, informing you of new service/ product offerings, and collecting feedback in relation to the Platform and the use of the Services, or sharing information with you about certain promotions or features in relation to the Platform. You may receive such communication when you have registered as a User of the Platform.
  • If we are involved in a merger, acquisition, due diligence, reorganization, bankruptcy or liquidation where the Company’s business will not continue as a going concern, receivership, sale of the Company’s assets, or transition of the Services to another provider, then your Information may be transferred as part of such a transaction as permitted by applicable laws and/or contract. The use of your Information following any of these events will be governed by the policies in effect at the time the applicable Information was collected.
  • As we continue to develop our business, we might sell or buy subsidiaries or business units. In such transactions, Personal Information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Policy (unless, of course, the user consents otherwise). Also, in the unlikely event that AntWalk or substantially all its assets are acquired, Information will of course be one of the transferred assets.
  • Storing and Processing Your Information

    The information that you provide will be mostly stored electronically. However, some information might also be kept in physical form.

    Subject to relevant regulations, we may engage into arrangements with Third Parties (in or outside of India) to store or process your information. These Third Parties may have their own security standards to protect this information, but we will demand that they adopt acceptable security standards in accordance with any applicable legislation on a commercially reasonable basis. Please be aware that by accepting this Policy, you expressly consent to and authorise the sharing of your Information with such Third Parties for storage and processing.

    Sharing & Disclosure of Your Information

    You hereby irrevocably consent and authorise the Company to transfer, share, disclose, or otherwise make available all or any of your Information, both inside and outside of India, to different group entities, Third Party service providers (without reference to persona or identity), government agencies upon such agency's direction, to any other third party, or to any other person / entity as required by law with bonafide intention.

    We will also share Information that we have about you (except your email address) with instructors or teaching experts for educational content you access or request information about, so they can improve their content for you and other students. This data may include things like your country, browser language, operating system, device settings, the site that brought you to AntWalk, and certain activities on AntWalk Platform, like enrolled courses and course review.

    If any Information is transferred, shared, revealed, or otherwise disposed of in this manner, we will work to contractually obligate the parties receiving the information to uphold the same standard of data protection that the Company has maintained, according to relevant laws.

    You acknowledge and agree that it is sufficient that the Company will attempt to impose contractual obligations on the transferee, which will require the transferee to abide by the terms of this Policy, when the Company transfers your and/or a Child User's Information, in accordance with the provisions of this Policy, to any other entity inside or outside your country of residence.

    The Company may transfer, disclose, or share Information (other than Sensitive Personal Data) with third parties who assist us in running our business, such as those who provide technical infrastructure services, analyse how users interact with our Services, assess the effectiveness of advertisements, provide customer or buyer services, facilitate payments, or carry out academic research and surveys. The Company will work to have such transferees sign contracts with confidentiality obligations that are compliant with this Policy.

    When the Company determines that it is necessary to do so in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, including any User and/or Child User, violations of various terms and conditions or our policies, including this Policy, the Company may also share Information with such third parties or in other ways to enforce this Policy.

    We reserve the right to divulge your Information when required to do so by applicable laws or regulations, or under any legal obligation or order under applicable laws, or in response to a request from a law enforcement or governmental agency, judicial, quasi-judicial, or any other statutory or constitutional authority, or to protect our rights, safety, and property, or to establish, exercise, or defend against legal claims our legal rights.

    International Data Transfers

    Our website is primarily operated and managed on servers located and operated within India. However, owing to the global nature of AntWalk, your Information may also be stored in Third Party data servers located in other countries where AntWalk provides its products and Services.

    AntWalk engages experts and other third parties for facilitating our products, service offerings and to offer support services to you, and your Information may be transferred to servers of such sub-contractors, service providers and other third parties. Depending upon the location of our service providers, your information, including Personal Data, may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

    Where required under applicable law we will seek your express consent for such transfers. In all other cases, by consenting to this Policy, you also provide consent AntWalk to transfer your Information to AntWalk affiliated companies, experts or any third-party entity in locations around the world.

    Where AntWalk transfers your Information internationally, we will comply with applicable legal requirements and where required we will enter into a data transfer agreement with the recipient of the Information, which in the case of European Personal Data may include the standard contractual clauses.
